In Georgia there are two laws that define the threshold a student's attendance must surpass before the matter can be referred to the court of jurisdiction. O.C.G.A. 20-2-290.1 (Mandatory Education) sets for the requirements that parents/ guardians have to enroll a student between the ages of six and sixteen in a private, public or home study program. This code section stipulates educational neglect can be presumed to occur once a student has accrued five unexcused absences. O.C.G.A 20-2-690.1 also defines the consequences that parents/ guardians may face for non-compliance of this code section. The consequences include: fines, jail time, probation and any thing deemed appropriate by the court. O.C.G.A. 15-11-381 (Definitions) defines a truant as a student who has accrued ten or more unexcused absences. For more information please visit: www.lexisnexis.com
